1. Aceptación de los términos

Al descargar, instalar o utilizar Medist ("la App"), aceptás estos Términos de uso ("Términos"). Si no estás de acuerdo con alguno de estos Términos, no utilices la App.

2. Descripción del servicio

Medist es una aplicación móvil para organizar y gestionar el historial médico personal y familiar. Las funciones incluyen:

• Creación de perfiles de salud propios y familiares
• Registro de visitas médicas con notas y adjuntos (fotos, PDFs)
• Grabación de audio de consultas médicas con transcripción y resumen generados por inteligencia artificial
• Seguimiento de condiciones de salud
• Recordatorios de citas, medicamentos y controles
• Preguntas para preparar consultas médicas

El acceso completo a Medist requiere una suscripción paga.

3. Descargo médico

Medist NO es un servicio médico ni de salud.

• No proporciona diagnósticos, tratamientos ni recomendaciones médicas.
• Los resúmenes y transcripciones generados por inteligencia artificial son orientativos y pueden contener errores o inexactitudes.
• No reemplaza la consulta con profesionales de salud calificados.
• El usuario es el único responsable de las decisiones que tome respecto a su salud o la de terceros.
• En caso de emergencia médica, contactá a los servicios de emergencia de tu localidad.

4. Elegibilidad y cuentas

• Debés tener al menos 13 años para usar Medist.
• Si sos menor de 18 años, necesitás el consentimiento de un padre, madre o tutor legal.
• Los usuarios adultos pueden crear perfiles para menores bajo su responsabilidad.
• Sos responsable de mantener la seguridad de tu cuenta y contraseña.
• Debés notificarnos inmediatamente si sospechás un uso no autorizado de tu cuenta.

5. Suscripciones y pagos

• Medist ofrece planes de suscripción mensual y anual. Los precios vigentes se muestran en la App.
• El plan anual incluye un período de prueba gratuito de 14 días.
• Las suscripciones se renuevan automáticamente a través de Apple App Store o Google Play Store.
• Podés cancelar tu suscripción en cualquier momento desde la tienda correspondiente (App Store o Google Play). La cancelación se efectiviza al finalizar el período de facturación vigente.
• No se otorgan reembolsos por períodos parciales, según las políticas de Apple y Google.
• La función "Restaurar compras" está disponible en la App para recuperar suscripciones existentes en un nuevo dispositivo.
• Medist puede modificar los precios de suscripción con aviso previo.

6. Contenido del usuario

• Conservás la propiedad de todos los datos que ingreses en Medist.
• Al usar la App, otorgás a Medist una licencia limitada para procesar, almacenar y mostrar tus datos con el fin de brindarte el servicio.
• Sos responsable de la veracidad y exactitud de la información que ingreses.
• Los datos de audio se procesan mediante servicios de inteligencia artificial de terceros (OpenAI) para generar transcripciones y resúmenes.

7. Funciones de inteligencia artificial

• Medist utiliza inteligencia artificial para transcribir audio y generar resúmenes de visitas médicas.
• Los resultados son aproximados y pueden contener inexactitudes. No deben considerarse como información médica verificada.
• El usuario debe verificar toda información generada por IA antes de tomar decisiones basadas en ella.
• Se aplican límites de uso diarios: 25 transcripciones y 25 resúmenes por día.
• El contenido de audio y notas se envía a proveedores de IA (OpenAI) para su procesamiento.

8. Grabación de audio y consentimiento de terceros

Al utilizar la función de grabación de audio, sos el único responsable de obtener el consentimiento de todas las personas presentes en la consulta antes de iniciar la grabación. Medist no se hace responsable por grabaciones realizadas sin el consentimiento adecuado. Te recomendamos informar a tu profesional de salud antes de grabar.

9. Perfiles compartidos

• El propietario de un perfil puede invitar a otros usuarios como editores.
• El propietario es responsable de gestionar los accesos a sus perfiles.
• Los editores invitados acceden a toda la información del perfil compartido sin excepción: datos personales, visitas médicas, grabaciones de audio, transcripciones, resúmenes de IA, adjuntos, condiciones de salud, recordatorios, preguntas, y todo dato asociado al perfil.
• El propietario puede revocar el acceso de un editor en cualquier momento.
• Las invitaciones de acceso expiran en 24 horas.
• El usuario que comparte un perfil asume la responsabilidad de que los datos de terceros (por ejemplo, un hijo) sean compartidos con las personas invitadas.

10. Uso aceptable

Al usar Medist, te comprometés a no:

• Utilizar la App para fines ilegales o no autorizados.
• Intentar acceder a datos de otros usuarios sin autorización.
• Intentar interferir con el funcionamiento del servicio o sus sistemas.
• Cargar contenido malicioso, ofensivo o ilegal.

11. Propiedad intelectual

Medist, incluyendo su diseño, código, marcas y contenido, es propiedad de [NOMBRE_LEGAL]. El usuario no adquiere derechos sobre la App más allá del derecho limitado de uso personal otorgado por estos Términos.

12. Limitación de responsabilidad

• El servicio se provee "tal cual" (AS IS), sin garantías de ningún tipo, expresas o implícitas.
• Medist no garantiza la disponibilidad ininterrumpida del servicio.
• Medist no se responsabiliza por pérdida de datos, decisiones médicas basadas en la App, ni errores en contenido generado por IA.
• En la máxima medida permitida por la ley, la responsabilidad total de Medist se limita al monto pagado por el usuario en los últimos 12 meses.

13. Indemnización

Aceptás indemnizar y mantener indemne a [NOMBRE_LEGAL], sus directores, empleados y afiliados, ante cualquier reclamo, demanda, daño, costo o gasto (incluyendo honorarios legales) que surja de: (a) tu uso de la App en violación de estos Términos; (b) la grabación de audio sin consentimiento adecuado de las personas grabadas; (c) la información que ingreses sobre terceros sin su autorización; (d) cualquier violación de leyes o derechos de terceros.

14. Fuerza mayor

Medist no será responsable por incumplimientos o demoras causados por circunstancias fuera de su control razonable, incluyendo pero no limitado a: desastres naturales, interrupciones de internet, fallas de proveedores de servicios, pandemias, actos de gobierno o conflictos.

15. Terminación

• Podés dejar de usar la App en cualquier momento.
• Medist puede suspender o cancelar cuentas que violen estos Términos.
• Tras la eliminación de una cuenta o perfil, los datos se conservan durante 30 días (eliminación suave) y luego se purgan definitivamente.

16. Supervivencia

Las secciones 3 (Descargo médico), 6 (Contenido del usuario), 8 (Grabación de audio), 11 (Propiedad intelectual), 12 (Limitación de responsabilidad), 13 (Indemnización) y 18 (Resolución de disputas) sobrevivirán a la terminación de estos Términos.

17. Modificaciones a los términos

Medist puede modificar estos Términos en cualquier momento. Los cambios significativos se notificarán a través de la App. El uso continuado de Medist después de la notificación implica la aceptación de los nuevos Términos.

18. Resolución de disputas

• Estos Términos se rigen por las leyes de la República Argentina.
• Ante cualquier controversia, las partes intentarán una resolución amigable antes de iniciar acciones legales.
• Serán competentes los tribunales ordinarios de la Ciudad Autónoma de Buenos Aires, República Argentina.

19. Separabilidad

Si alguna disposición de estos Términos es declarada nula o inaplicable, las disposiciones restantes mantendrán su plena vigencia y efecto.

1. Acceptance of terms

By downloading, installing, or using Medist ("the App"), you accept these Terms of Use ("Terms"). If you do not agree with any of these Terms, do not use the App.

2. Description of the service

Medist is a mobile application for organizing and managing personal and family medical history. Features include:

• Creating personal and family health profiles
• Recording medical visits with notes and attachments (photos, PDFs)
• Audio recording of medical appointments with AI-generated transcription and summaries
• Health condition tracking
• Reminders for appointments, medications, and check-ups
• Questions to prepare for medical appointments

Full access to Medist requires a paid subscription.

3. Medical disclaimer

Medist is NOT a medical or health service.

• It does not provide diagnoses, treatments, or medical recommendations.
• AI-generated summaries and transcriptions are for reference only and may contain errors or inaccuracies.
• It does not replace consultation with qualified health professionals.
• The user is solely responsible for any health-related decisions they make for themselves or others.
• In case of a medical emergency, contact your local emergency services.

4. Eligibility and accounts

• You must be at least 13 years old to use Medist.
• If you are under 18, you need consent from a parent or legal guardian.
• Adult users may create profiles for minors under their care.
• You are responsible for maintaining the security of your account and password.
• You must notify us immediately if you suspect unauthorized use of your account.

5. Subscriptions and payments

• Medist offers monthly and annual subscription plans. Current prices are displayed in the App.
• The annual plan includes a 14-day free trial.
• Subscriptions renew automatically through the Apple App Store or Google Play Store.
• You may cancel your subscription at any time from the respective store (App Store or Google Play). Cancellation takes effect at the end of the current billing period.
• No refunds are provided for partial periods, in accordance with Apple and Google policies.
• The "Restore purchases" feature is available in the App to recover existing subscriptions on a new device.
• Medist may change subscription prices with prior notice.

6. User content

• You retain ownership of all data you enter in Medist.
• By using the App, you grant Medist a limited license to process, store, and display your data in order to provide the service.
• You are responsible for the accuracy of the information you enter.
• Audio data is processed by third-party AI services (OpenAI) to generate transcriptions and summaries.

7. Artificial intelligence features

• Medist uses artificial intelligence to transcribe audio and generate summaries of medical visits.
• Results are approximate and may contain inaccuracies. They should not be treated as verified medical information.
• Users must verify all AI-generated information before making decisions based on it.
• Daily usage limits apply: 25 transcriptions and 25 summaries per day.
• Audio content and notes are sent to AI providers (OpenAI) for processing.

8. Audio recording and third-party consent

When using the audio recording feature, you are solely responsible for obtaining consent from all persons present in the consultation before starting the recording. Medist is not responsible for recordings made without adequate consent. We recommend informing your healthcare provider before recording.

9. Shared profiles

• Profile owners may invite other users as editors.
• The owner is responsible for managing access to their profiles.
• Invited editors gain access to all information in the shared profile without exception: personal data, medical visits, audio recordings, transcriptions, AI summaries, attachments, health conditions, reminders, questions, and all data associated with the profile.
• The owner may revoke an editor's access at any time.
• Access invitations expire after 24 hours.
• The user sharing a profile assumes responsibility for third-party data (e.g., a child's data) being shared with the invited persons.

10. Acceptable use

When using Medist, you agree not to:

• Use the App for illegal or unauthorized purposes.
• Attempt to access other users' data without authorization.
• Attempt to interfere with the operation of the service or its systems.
• Upload malicious, offensive, or illegal content.

11. Intellectual property

Medist, including its design, code, trademarks, and content, is the property of [NOMBRE_LEGAL]. Users do not acquire any rights to the App beyond the limited right of personal use granted by these Terms.

12. Limitation of liability

• The service is provided "as is" without warranties of any kind, express or implied.
• Medist does not guarantee uninterrupted availability of the service.
• Medist is not liable for data loss, medical decisions based on the App, or errors in AI-generated content.
• To the maximum extent permitted by law, Medist's total liability is limited to the amount paid by the user in the preceding 12 months.

13. Indemnification

You agree to indemnify and hold harmless [NOMBRE_LEGAL], its directors, employees, and affiliates, against any claims, demands, damages, costs, or expenses (including legal fees) arising from: (a) your use of the App in violation of these Terms; (b) audio recording without adequate consent from recorded persons; (c) information you enter about third parties without their authorization; (d) any violation of laws or third-party rights.

14. Force majeure

Medist shall not be liable for failures or delays caused by circumstances beyond its reasonable control, including but not limited to: natural disasters, internet disruptions, service provider failures, pandemics, government acts, or conflicts.

15. HIPAA disclaimer (United States)

Medist is not a HIPAA-covered entity and does not claim HIPAA compliance. The App is not intended for use by healthcare providers as part of a medical record system. Medist is a personal health organization tool for individual consumers.

16. Termination

• You may stop using the App at any time.
• Medist may suspend or terminate accounts that violate these Terms.
• After account or profile deletion, data is retained for 30 days (soft delete) and then permanently purged.

17. Survival

Sections 3 (Medical disclaimer), 6 (User content), 8 (Audio recording), 11 (Intellectual property), 12 (Limitation of liability), 13 (Indemnification), and 19 (Dispute resolution) shall survive termination of these Terms.

18. Changes to these terms

Medist may modify these Terms at any time. Significant changes will be communicated through the App. Continued use of Medist after notification constitutes acceptance of the updated Terms.

19. Dispute resolution

• These Terms are governed by the laws of the Argentine Republic.
• In case of any dispute, the parties shall attempt amicable resolution before initiating legal proceedings.
• The ordinary courts of the City of Buenos Aires, Argentine Republic, shall have jurisdiction.

20. Binding arbitration and class action waiver (for users outside Argentina)

BINDING ARBITRATION: Any dispute arising from these Terms or your use of the App shall be resolved through binding arbitration rather than in court, except as noted below.

CLASS ACTION WAIVER: You agree to resolve disputes with Medist on an individual basis only. You waive any right to participate in a class action, class arbitration, or representative proceeding.

EXCEPTIONS: Either party may bring claims in small claims court. Nothing in this section prevents you from bringing issues to the attention of governmental agencies.

This section does not apply to users in jurisdictions where arbitration clauses or class action waivers are prohibited by law.

21. Severability

If any provision of these Terms is declared null or unenforceable, the remaining provisions shall remain in full force and effect.
